Implementation of Infrastructure for GST.
The government is likely to appoint State Bank of India as the clearing bank for the proposed Goods and Services Tax (GST) and National Securities and Depositories Ltd (NSDL) as the clearing corporation for implementing the infrastructure required for inter-state tax administration.
A special purpose vehicle (SPV) would be set up for information technology infrastructure in GST. Called ‘GST N’ (Network), it would have the Union government, state governments and technology partner NSDL as stakeholders. Sources say the government is likely to make these appointments official to prepare ground for quicker implementation of GST.
NSDL and SBI will have to ensure the tax, especially in inter-state transactions, is collected and processed without procedural delay and distributed to states on a set schedule.
P Chidambaram, former Union finance minister, aimed to get GST rolling by April 1, but the deadline was re-set to April 1, 2011. The appointment of the two lead organisations would help them prepare and test their systems much in advance, an official said.
Introduction of GST will probably be India’s most ambitious tax reform to bring all states on a par and ensure higher and more transparent collection of taxes by the government. It is hoped that the system can check tax evasion at any level.
Central sales tax will be replaced by the consumption-based GST. In case of inter-state transactions, NSDL might be given special powers to distribute taxes to the states concerned after making a collection in any other state, said an official with knowledge of the matter. The IT network of NSDL and the vast branch network of SBI made them natural choices to ensure that all states get the taxes due to them fairly and quickly, the official said.
NSDL has the experience, as it had set up the tax information network for the income tax department, which is running well.
In 2004, the Task Force on Implementation of the FRBM Act, chaired by Vijay Kelkar, had also said that the existing systems should be used for GST implementation, both at the Centre and at the state level. As the tax information network was set up by NSDL, it seemed a natural choice for GST.
Tax experts believe this is a step in the right direction, but the challenge will be implementation. At some stage, the system would need to have the ability to process, verify and reconcile the dealer/invoice details uploaded by inter-state suppliers. The other big challenge would be to expand the coverage to states where IT penetration is relatively low, to facilitate online registrations/filings/payments for all taxpayers.
Individuals and companies can expect some relief in the Direct Taxes Code (DTC), with the government planning to widen personal income-tax slabs, enhance the exemption limit and remove levies on corporate tax. This comes with the Cabinet clearing the Direct Tax code which will be introduced in Rajya Sabha, and referred it to a select committee, during the monsoon session.
It has been referred to the Select Committee, and will be introduced in Rajya Sabha on Monday.
The proposed slabs are, however, a climb down from what was proposed in the first discussion paper on DTC, released last August. The government had then proposed to do away with most exemptions, including savings instruments, by taxing them at the time of withdrawal. But bowing to pressure, the governmentdropped the plan.

The limit for exemptions for salaried people is Rs. 2 lakh, while that for senior citizens is Rs. 2.5 lakh.
The earlier DTC draft had proposed to reduce the corporate tax to 25 per cent from the present 30 per cent but the revised direct tax code has been kept the same at 30%.
Also, unlike the original proposal that sought to impose minimum alternate tax (MAT) on gross assets, which drew strong criticism, the government has now decided to continue with the system of levying MAT on book profits. The MAT rate is, however, proposed to be increased from the present 18 per cent to 20 per cent.
The new Code comes into effect from April, 2011.
After the approval of the Cabinet, the decks are cleared for tabling the legislation in the Monsoon Session of Parliament so that the new Act ushering in reduced tax rates and exemptions may come into effect from next fiscal.
When enacted, the Code will replace the archaic Income Tax Act and simplify the whole direct tax regime in the country.
The Code aims at reducing tax rates, but expanding the tax base by minimising exemptions.
The Finance Ministry had earlier come out with a draft on the (Direct Tax Code) DTC bill, some of whose provisions drew strong criticism from industry as well as the public.
To address those issues, the ministry brought out the revised draft, dropping earlier proposals of taxing provident funds on withdrawal and levying Minimum Alternate Tax on corporates based on their assets.
“As of now, it is proposed to provide the EEE (Exempt-Exempt-Exempt) method of taxation for Government Provident Fund (GPF), Public Provident Fund (PPF) and Recognised Provident Funds (RPF) …”, the revised DTC released by the Finance Ministry said.
The revised draft also puts pensions administered by the interim regulator PFRDA, including pension of government employees who were recruited since January 2004, under EEE treatment.
The first DTC draft had proposed to tax all savings schemes including provident funds at the time of withdrawal bringing them under the EET (Exempt-Exempt-Tax) mode.
Under the EEE mode, the tax exemption is enjoyed at all the three stages – investment, accumulation and withdrawal.
The revised proposal has also made it clear that tax incentives on housing loans will continue. Payment on interest on housing loans up to Rs. 1.5 lakh will continue. The earlier draft was silent on housing loans.

Delhi Income Tax Department Failed to Produce 95 percent of Records asked by CAg
The Delhi Income Tax (I-T) department is facing criticism for its administrative inefficiency by failing to produce 95.4 per cent of records asked by the Comptroller and Auditor General of India (CAG) for its performance audit for financial year 2009-10. This is the highest failure rate of I-T department in providing records to the CAG. Delhi is followed by Punjab (53.4 per cent), Orissa (50.9 per cent), Uttarakhand (47.7 per cent), Maharashtra (46.3 per cent) and Gujarat (39.9 per cent).
Chandigarh (UT), Goa, Haryana, Himachal Pradesh and Kerala — have emerged as the best states by providing 100 per cent records to the CAG.
A CAG report has revealed that against 8,873 records requisitioned by the CAG for auditing, Delhi’s I-T department produced only 410. “Non-production of records despite repeated requests was a serious constraint as well as a matter of concern,” the report observes.
This comes as a blow to the department’s credibility, after Finance Minister Pranab Mukherjee’s recent remark on I-T department being the largest litigant in the government of India.
“In future, the CAG will look into this performance aspect and work to find out the reasons of department’s inability to produce records,” said Anupam Kulshreshtha, deputy Comptroller & Auditor General.
